Summary
Position requires reliable, dependable, experienced collector with a minimum of 2-3 years of experience with Fair Debt Collection Practices Act (FDCPA), making outgoing collection calls, taking incoming calls, negotiating settlements and pay-offs, working with customers, ordering suits and bank & wage garnishments specifically concentrating on bankruptcy and foreclosures. Time requirements include occasional evenings and Saturdays.


Duties
Servicing accounts where the customer has filed bankruptcy to determine the appropriate actions. Make sound business decisions based on bankruptcy law, property valuation and customer intent to prevent financial loss to the bank.

Manage timelines involved with Chapter 7 and Chapter 13 accounts, including motions for relief, dismissals, discharges and commencement of foreclosure.

Complete appropriate contact with attorney and customer (where allowed) to negotiate reaffirmation agreements in Chapter 7 bankruptcies.

Recommend when to place accounts for foreclosures on delinquent real estate mortgage loans and when to assign to attorney for legal action.

Maintain and apply knowledge in the current Bankruptcy Code. Must be able to discuss options with attorney regarding reaffirmation agreements, retention and surrendering of collateral.

Prepare appropriate forms and ensure complete documentation and compliance within established guidelines; notify appropriate Manager of unique situations.

Performs such other clerical and collection activity as assigned.


Qualifications
Minimum of 2-3 years collections with foreclosure or bankruptcy experience.

Thorough knowledge of collections, foreclosure and bankruptcy procedures and appropriate knowledge of FDCPA & Federal Bankruptcy Laws.

Strong attention to detail to ensure that the proper county codes, suit codes for local courts are utilized, and current and accurate customer information is used in all filings.

Strong phone skills and presence to negotiate with customer while maintaining a professional and calm demeanor.

Attentive listening skills and persuasive manner to negotiate win-win payment, settlement, and pay-off arrangements.

Understanding of Horizon Bank lending & collection programs and policies.
